Terms of Service
Last updated
These terms are an agreement between you and Nobl Creative LLC, a Missouri limited liability company ("Nobl Creative," "we," "us"), which makes Mullio. They cover the app at app.mullio.io and the website at mullio.io.
By creating an account or using Mullio, you agree to these terms and to the Privacy Policy. If you're using Mullio for a studio or company, you're agreeing for it too, and you confirm you're allowed to.
Who can use Mullio
- You must be at least 18 and using Mullio for your business.
- Give accurate information when you sign up, and keep your password to yourself. You're responsible for what happens under your account. Tell us right away if you think someone else has gotten in.
- Your clients don't need an account. They use the private links you send them, and these terms don't bind them. You're responsible for how Mullio is used on your behalf with your clients.
Early access
Mullio is in early access. That means:
- It's free for now.
- Features will change, and some may be added, reworked or removed.
- There may be bugs and occasional downtime.
We'll do our best to keep Mullio running and your information safe, but during early access we can't promise any particular level of availability.
Paid plans
We plan to charge for Mullio. Before anything you use costs money, we'll email you at least 30 days ahead with the price and the terms. Nothing will be charged unless you choose a paid plan. If you don't, you can keep access long enough to get a copy of your information.
Your information
- It's yours. You own what you and your clients put into Mullio: client details, projects, notes, forms, answers, messages and files.
- What you let us do with it. You give us permission to store, process, copy and display it, and to send it by email or notification, only as needed to run Mullio for you, keep it secure and support you. This includes sending email to your clients on your behalf when you use features that do that, such as emailing a client their link or a new-message notice.
- You're responsible for having the right to put it there. That covers your clients' names, contact details and property information, and the files you upload. Make sure you're allowed to share it and to contact your clients through Mullio, and handle it the way the law and your own privacy promises to clients require.
- Getting a copy and leaving. You can ask us for a copy of your information at any time, and ask us to delete your account and everything in it. See the Privacy Policy for how long deletion takes.
Client pages and links
Client pages, forms and file links use long, random web addresses that can't be guessed. Anyone who has the link, though, can open it. Send links only to the people they're for. If one gets shared with the wrong person, reset it from the client's page in Mullio, which turns off the old link.
What not to do
Don't use Mullio to:
- break the law, or infringe anyone's rights, including copyright and privacy
- send spam or messages people haven't agreed to receive
- upload viruses or anything else meant to cause harm
- harass, threaten or deceive anyone
- get into accounts, studios or information that aren't yours, or test Mullio's security without our written permission
- copy, resell or reverse-engineer Mullio, or overload it with automated requests
We may remove content that breaks these rules, and suspend or close accounts that do.
Keep your own copies
Mullio helps you track your work, but it isn't a backup service or a document archive. Keep your drawings, contracts and other important files in your own records too. Mullio doesn't replace your CAD software, accounting, contracts or professional judgment, and you're responsible for your work, your schedule and what you promise your clients.
Our part
Mullio's software, design, name and logo belong to Nobl Creative. These terms give you the right to use Mullio, not to own it. If you send us ideas or feedback, we may use them without owing you anything.
Mullio relies on a few outside services to work, such as hosting and email. They're listed in the Privacy Policy. We're not responsible for outages or problems on their side, though we'll work to limit the effect on you.
Ending things
- You can stop using Mullio at any time, and ask us to delete your account.
- We can suspend or close an account that breaks these terms, puts others at risk, or that we're required by law to close. Except where there's a risk of harm, we'll tell you first and give you a chance to get a copy of your information.
- If we ever shut Mullio down, we'll give at least 60 days' notice and a way to export your information.
Disclaimers
Mullio is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Mullio will be uninterrupted or error-free, or that information will never be lost.
Limits on our liability
To the extent the law allows:
- Nobl Creative and its members won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, even if we were told they were possible.
- Our total liability for any claim about Mullio is limited to the greater of what you paid us for Mullio in the 12 months before the claim, or $100.
Indemnity
You agree to defend and hold harmless Nobl Creative and its members from claims, losses and costs, including reasonable legal fees, that come from what you put into Mullio, how you use it with your clients, or your breaking these terms.
The law that applies
These terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Missouri, and both sides agree to those courts' jurisdiction. Before filing anything, please email us. Most problems can be sorted out with a conversation.
Changes to these terms
We may update these terms as Mullio changes. We'll update the date at the top. For changes that matter, we'll email account owners at least 14 days before they take effect. If you keep using Mullio after that, you're agreeing to the new terms.
The rest
- These terms and the Privacy Policy are the whole agreement between us about Mullio.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce something right away, we haven't given up the right to later.
- You can't transfer your account or these terms without our consent. We can transfer them as part of a merger or sale of the business.
